While I admire Mozilla's aversion to patented codecs, rather than defining Theora only they should really default to the codecs available on the system (if that's possible). After all, what if I want to use Dirac?

Unfortunately that's not very reasonable backrow, it would be a nightmare to have the <video> tags work with every format out there.. as individuals would need to keep obtaining codecs and configuring (..possibly recompiling) the browser each time, or being unable to obtain them at all.. i.e: proprietary stuff.
Firefox includes a Theora/ogg decoder that works on all of their supported platforms, it doesn't depend on any 3rd party library support.. and some sites have encoded their videos in that (..open) format. Can you imagine having a plethora of sites/browsers supporting the new tag with many opinions on the best codec? how is it any different from a proprietary web using Adobe Flash? The question of what codecs people have available is little different then what fonts they have available, only you can't fallback on the browsers default.
It's to late for the web to be a perfect place, we can only live in it, and try to leave it better then we found it.
